Our site is reserved to adults over the age of eighteen (18) years old. By using this site, you declare that you are over 18 years of age.
1. Registration for the AcademyMembership
By registering for the Academy, you will be able to access short excerpts of our online resources including instructional videos, scientific papers and expert interviews along with lots of other useful content and online training related to plastic surgery and dermatology.
You agree to provide accurate and complete information. If we have reasonable grounds to believe that the information provided is inaccurate or incomplete, we may have the right to refuse the creation of your account or to suspend or terminate it, when already created. We also reserve the right to verify the accuracy of any information given, especially the information relating to the professional category of a Member.
Membership is strictly individual and limited to 1 (one) per person. Members are not permitted to share their credentials with third parties. Members are responsible for maintaining the confidentiality of their credentials. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security, and equally agree to securely log out of your account at the end of each session. We will not be held liable for any loss or damage arising from your failure to protect your password or account information.
We may reduce or increase the length and amount of excerpts available to the Members of the Academy. We may also restrict the access for Members to some content available on the Academy.Premium Membership
Members may subscribe for premium Membership and pay a subscription on the basis of one of the plans offered on the Academy website.
For premium Membership, the access policy of IMCAS will establish the category of content available on the Academy on the basis of professional categories (physicians / non-physicians). Each category provides access to a determined content in the Academy.
IMCAS will determine the conditions of eligibility for each category, requiring sufficient identification and supporting documents. We may also require proof of professional qualifications of any Member to enable access to some content.
Price and payment terms may be subject to change. Price modifications will not affect the payment terms agreed for prior premium registrations. Different prices and payment terms may apply to physicians and non-physicians.
Premium Memberships are valid for a 1-year period. Once this period expires, content will be no longer accessible from the expired account. Unless otherwise requested, continuing to use the ACADEMY will imply the tacit renewal of a subscription.
In the event of failure to comply with a payment, IMCAS reserves the right to deny access and/or to terminate the premium Membership.
For clinics, hospitals or other organizations, a group account with a group license access may be conferred upon request. Such requests need to be addressed and approved by the Academy administration (firstname.lastname@example.org).
2. License to access and use our content
All content and materials featured on the Academy are the exclusive property of IMCAS and/or any of the authors of such content (the practicing physician/s and/or speaker/s and/or the patient/s). These materials may be protected by copyright law, trademark law, data privacy law, patent law, database rights and protection, image and intimacy rights and may also be protected by other laws depending on the country.
The visual interfaces, graphics, design compilation, information, trade dress, database and computer code (including source code and objet code), software, services, and all other elements of the Academy’s platform are the exclusive property of IMCAS and shall not be extracted without permission.
By registering for the Academy, IMCAS grants you a personal, non-exclusive, non-transferable and revocable license to access and use any material available on the Academy subject to the conditions of a Membership or premium Membership.
Members may access material of the Academy only for their own personal and non-commercial use. Members are not allowed to use the Academy to promote a product, service, medical procedure, business, doctor or other individual. Members may not modify, translate, adapt, merge, make derivative works, disassemble, decompile, reverse compile or reverse engineer any part of the Academy website. You shall not use any manual or automated software, devices, or other processes (including but not limited to spiders, robots, scrapers, crawlers, avatars, data mining tools, or any related technique) to “scrape” or download data from any web pages contained in the Academy website.
Members or any person accessing the Academy may not copy, reproduce, retransmit, broadcast, distribute, publish, commercially exploit or otherwise transfer by any means, any material available on the Academy without the written permission of IMCAS.
You are free to post a hypertext link to the Academy on your website or social networks, as long as the link does not state or imply any sponsorship of your site with IMCAS. However, you may not, without our prior written permission, frame or inline link any of the content of the Academy, or incorporate into another website or other service any of our material, content or intellectual property.
3. License to access and use your content
Members of the Academy may also provide content on the Academy such as documents, videos, photos and other content and so on. Members uploading content on the Academy are not authorized to upload such content on other e-learning medical platform that would directly or indirectly compete with the Academy.
You retain all ownership rights of your content and you acknowledge responsibility for it and any consequences of its display on the Academy.
By agreeing to these Terms you are granting IMCAS a license to use and display your content online. If you are not in a position or do not have the appropriate authorizations to grant such license, please do not upload your content on the Academy.
By posting your content, you grant us a non-exclusive (except under the conditions referred in the first paragraph above), transferable, sub-licensable, royalty-free, worldwide license to use, edit, modify, reproduce, copy, display, transmit, adapt, prepare derivative works of, publish and/or distribute your Content on the Academy in any and all media or distribution formats and channels (whether currently known or later developed) in connection with the Academy. Content owners have the right to withdraw their authorization for this license at any time. Up until that withdraw takes place, the license remains valid.
IMCAS also provides you features such as previews and excerpts of content uploaded on the Academy. These and other features may require our systems to access, store and scan your content. You give us permission to implement these features, and this permission extends to trusted third parties we work with.
4. Content availability
IMCAS does not engage to upload the entire set of content from any of the IMCAS congresses, nor any video in particular or content uploaded by Members.
Likewise, any content might be removed from the website without prior notice in the event of a withdrawal request by the rights holder of the content. In such event, IMCAS will not be held responsible for any breach of this agreement.
The service is provided “as is” and “as available”. We make every effort to ensure that the Academy remains accessible 24/7 but cannot be held responsible for the availability of the site in the event of an internet malfunction, maintenance operations, failure or bug, or any event of force majeure beyond the reasonable control of IMCAS.
IMCAS may also use encryption, tracking, coding or any other software technique to ensure that access to the Academy remains restricted according to the categories of membership.
This conduct includes but is not limited to: downloading, filming, broadcasting or reproducing before third parties, taking pictures or screenshots, sharing the use of an account with third parties.
Any conduct by means of reverse engineering or any software technique that leads to the conduct mentioned in the paragraph above as well as breaching the security related features of the Academy, is equally prohibited and will be equally prosecuted.
IMCAS shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the services of the Academy by its Members. Since the aforementioned exclusion or limitation of certain categories of damages may vary depending on the country, the above limitation may not apply to you. In such case, liability is limited to the fullest extent permitted by the law of such country.
IMCAS does not guarantee the scientific accuracy, reliability, timeliness, quality or suitability of the content of the Academy.
We reserve the right to take over the exclusive defence of any claim for which we are entitled to indemnification under this section. In such event, you agree to provide us with such cooperation as is reasonably requested by us.
7. Third party disclaimer
We may provide or repost links from the Academy to other sites maintained by third parties. Our link to such third-party sites does not imply any endorsement of the information, offers, products or services offered on or through these third party sites. We do not operate or control in any manner the information, products or services posted on these third-party sites.
8. Notice of Copyright Infringement
If you are a copyright, trademark, patent or intellectual property owner who believes your protected subject matter has been illegitimately featured on the Academy in a manner that constitutes an infringement, please inform us at: email@example.com.
Please include the following information in your written notice: (1) a detailed description of the intellectual property subject matter that is allegedly infringed upon; (2) a description of the location of the allegedly infringing material; (3) your contact information, including your address, telephone number and e-mail address; (4) a statement by you indicating that you have a good-faith belief that the allegedly infringing use is not authorized by the copyright owner, its agent, or the law; (5) a statement by you, made under penalty of perjury, affirming that the information in your notice is accurate and that you are authorized to act on the copyright owner's behalf; and (6) an electronic or physical signature of the copyright owner or someone authorized on the owner's behalf to assert infringement of copyright and to submit the statement.
You may also notify us of any material featured on the Academy that you believe is illicit or breaches any of your or third party other rights. In such case, you must provide a clear description of the rights you wish to invoke including a description of the material and the manner in which it infringes your rights.
9. Interaction and communication of Members
Members of the Academy may interact and communicate on the Academy through notably web alerts, webinars or commentaries.
You shall not interact with other Members or provide any communication that could be considered as inappropriate including notably but without limitation any offensive, defamatory or illicit communication. Moreover, you are solely responsible for the reliability and accuracy of any communication and/or information you will provide on the Academy.
IMCAS have the right to delete any inappropriate communication or content posted on the Academy but does not exercise any prior control on the interaction of Members and will not assume any liability or endorsement for any communication or content posted by Members.
10. Payments and cancellations
If you purchase a Premium Membership, your payment to the Academy will automatically renew at the end of the subscription period and IMCAS will charge your account from the beginning of the new subscription period. IMCAS will also automatically renew your Premium Membership each year unless you cancel your subscription. If your payment details are no longer correct at the date of renewal, you agree to provide IMCAS with new payment details.
You may cancel your Membership through your subscription page (https://www.imcas.com/en/academy/premium). The cancellation will take effect the day after the last day of the current subscription period for which you have already paid.
If you reside in a country which is part of European Union and have purchased a Premium Membership, you acknowledge and consent that the Premium Membership is considered as a digital content which is not supplied on a tangible medium and will be provided as soon as you subscribe to the Premium Membership. Thus, in application of the European Directive on consumer’s rights, no right of withdrawal is applicable for any purchase of Premium Membership.
IMCAS may change the price for the Premium Membership from time to time. This price changes will be duly communicated to you. Price changes for Premium Memberships will take effect at the start of the next subscription period following the date of the price change. If you refuse the price modification, you may terminate your Premium Membership before the end of the current subscription period.
If you subscribed to the Academy through a limited offer, or have purchased or obtained a promotional code to access to Premium Membership on the Academy, this Agreement applies equally to your access to the Academy. Any separate sets of terms and conditions presented to you along with the code or other limited offer also apply to your access to the Academy using the code or limited offer.
Promotional codes are not redeemable for cash and may not be returned for a cash refund, exchanged, resold or used to purchase other codes.
From time to time, we may offer Premium Membership trials for a specified period without payment (a “Trial”). IMCAS reserves the right, in its absolute discretion, to determine your eligibility for a Trial, and to withdraw or to modify a Trial at any time without prior notice and with no liability.
For some Trials, we’ll require you to provide your payment details to start the Trial. At the end of such Trials, we may automatically start to charge you for the Premium Membership on the first day following the end of the Trial. By providing your payment details in conjunction with the Trial, you agree to this charge. If you do not want this charge, you must cancel your subscription before the end of the trial period.
A Member may terminate this Agreement by closing his/her account on the Academy. In such event, the termination will operate from that moment on, meaning that the effects already occurred, including the payment for premium registration, will not be subject to refund or review.
In the event of a violation of this Agreement, IMCAS may decide to suspend or terminate the Membership. The decision will be fully discretional and will not be subject to review.
13. Data processing
In order to allow the proper functioning of the Academy, as well as for statistical purposes, IMCAS may retrieve information related to the visitors and Members. This includes but is not limited to: name, address, email, profession/medical specialty, website, country, location of the visitor or Member, hardware/software of use, payment method and cookies.
This data may eventually be disclosed to trusted third parties, under the condition that such data is kept anonymous, preventing any possible way of tracking or identifying the original data subject.
The information collected from you is subject to data processing by IMCAS. Any person whose data is collected has a right to access, rectify and delete the data concerning him/her, and the right to oppose for legitimate reasons the processing of his/her data. We may assign transfer, sub-license or sub-contract any of its rights or obligations under the Agreement to any third party without your prior written approval.
17. Applicable law and jurisdiction
The terms, interpretation and all claims arising from this agreement will be governed by the applicable laws of France. Any claims arising out of this agreement will be ruled by the jurisdictions of France.
